Foreign ownership in Indonesia, explained without the myths
The single most common question we get is whether a foreigner can own property in Indonesia. The honest answer is: not freehold, not directly — but that is far from the end of the conversation.
What Hak Milik actually means
Hak Milik (SHM) is full freehold title, and it is reserved for Indonesian citizens. No structure legally transfers SHM to a foreign individual. If someone offers you freehold in your own name, walk away — you are being offered a nominee arrangement, and nominee arrangements are void under Indonesian law. The nominee is the legal owner. You have no enforceable claim.
The routes that do work
Hak Sewa (leasehold) is the most common path. You lease the land for a fixed term — typically 25 or 30 years, often with an agreed extension — and own the building on it for that period. The lease is a contract, so the terms matter enormously: extension rights, transferability, and what happens on the landowner's death should all be explicit.
Hak Pakai (right to use) is available to foreigners holding a valid stay permit. It runs for 30 years, extendable by 20 and renewable for a further 30. It is registrable, mortgageable, and inheritable. For a residence you actually intend to live in, this is usually the cleanest option.
PT PMA — a foreign-owned Indonesian company — can hold Hak Guna Bangunan (right to build). This is the standard structure for commercial and rental businesses. It carries real reporting obligations and minimum capital requirements, so it only makes sense when there is genuine business activity behind it.
The trap
The mistake we see most often is a buyer paying freehold prices for a leasehold asset with 18 years remaining. A lease is a wasting asset. A 30-year lease at year one and the same lease at year twelve are not the same purchase, and should not be the same price.
